Federalism and immigration policy: Burkhart provides insight

In an article for the Los Angeles Times, political science professor Ross Burkhart highlighted a challenge related to the Trump administration’s active efforts to centralize initiatives surrounding immigration: the federalism that is contained in the U.S. Constitution.

Burkhart explained that with the federal government interpreting laws such as the Posse Comitatus Act and the Insurrection Act in ways that emphasize the federal presence in enforcing immigration laws, the state powers of policing as directed under the Constitution could well be diminished in favor of more of a nationwide, federally-based security state.
